Terms and Conditions of Sale

By bidding or purchasing a coin in the Zuzim Inc. Buy or Bid coin sale the customer acknowledges that they have read and accept the following sale terms and conditions:

1. Customers may purchase the item at the ‘Buy’ price any time during the sale. Customers may also place a bid. Placing a bid constitutes a legally binding offer to buy. By bidding in the sale the bidder personally guarantees payment. Lots not purchased outright will be awarded to the bidder with the highest acceptable bid at the close of the auction. All items are subject to prior sale. The sale will close two weeks after it is launched, at 9PM EST. If there is a reserve on the item, the bid must meet the reserve. In all cases it is the right of Zuzim Inc. to determine the level at which a bid is considered acceptable. Zuzim Inc. may initiate a reserve or minimum at any point during the sale.

2. Bids or purchases may be made through the website, by email or by regular mail. Purchases are made, or bids effected in the order they are received by us. The bidder is responsible for verifying that a bid was received. A purchase at the ‘buy’ price supersedes all bids and the item is sold to the purchaser. All items are still subject to prior sale. Zuzim Inc. reserves the right to withdraw any lot at any time, until the purchaser has taken physical possession of the lot.  No consignor, purchaser or bidder shall have a right to claim any damages, direct, consequential or otherwise, if a lot is withdrawn, even after the sale.

3. We reserve the right to reject any bid, to determine the opening price, to reopen bidding in the case of a dispute, to rescind a sale in case of a dispute, or to bid on behalf of the consignor or Zuzim Inc. In all cases Zuzim Inc.’s decision will be final.

4. There is NO Buyer’s fee in our Buy or Bid sale. You read correctly. The Buyer’s fee is 0%

5. Invoices are due and payable immediately upon receipt. Payments must be received within 7 days of the sale date. In the event a successful bidder fails to make full payment within the allotted time Zuzim reserves the right to deem the sale incomplete and to resell the material, and the bidder agrees to pay for the reasonable cost of such a sale and also to pay any difference between the resale price and the previously successful bid.

6. Bidders not known to us must establish credit by providing satisfactory credit references or pay a deposit, at our discretion, before bidding. Minors are not permitted to bid. Zuzim Inc. requires payment in full prior to delivery of lots. Title does not pass until lots are paid in full. Upon receipt of lots, the buyer assumes full responsibility for loss or damage. Delivery to the buyer’s address of record shall constitute receipt by the buyer regardless of the identity of the person accepting delivery. 

7. Payment can be made by check or money order denominated in US dollars. Bank wires are accepted for purchases exceeding $500. Credit cards (Visa, MasterCard, American Express & Discover) and Paypal are accepted for invoices up to $2,000. Credit card payments for invoices in excess of $2,000 will incur a 3% fee. Even if you pay directly through the website and are charged only for the invoice, you will still be liable to this fee. Paypal is not accepted for invoices exceeding $2,000.

8. Prices are in U.S. dollars $ and bids must be made in dollar $ amounts. Bids will be accepted between the listed increments only if they are the highest bid. Bids will be reduced starting from the reserve or lowest acceptable bid. Example: You bid $1,000 and the reserve is $700, your bid will be entered at $700. If a subsequent bidder bids $725, your bid will be raised to $750. If the other bidder bid $800 your bid will be raised to $850. If there are no other higher bidders, you will be awarded the lot at $850. See below for bidding increments.

9. A reserve may be placed on any lot. A ‘reserve’ means a confidential price below which we will not sell the item. Reserves will usually be between 60% - 80 % of the estimate. 

10. Sales tax, postage, handling and insurance are the responsibility of the buyer. International shipments are insured to $650 only, but may sometimes be insured for more only if special insurance arrangements are made. Under no circumstances will items be insured for amounts exceeding $2,500. Any amount exceeding the insured value is at the buyer’s sole risk. International customers are responsible for any VAT or customs fees to the country of import.

11. All coins are guaranteed genuine. Attribution, date, condition and other descriptions are our good faith opinion. Grading is an art, not a science and can even vary among experts. Zuzim Inc. offers no representation that an item has or has not been cleaned, that any toning is natural or artificial, that an item will meet the standards or grade of an independent grading service, that an item has a particular provenance or pedigree, or that a coin has been struck or produced in a particular style. Any and all statements concerning such matters reflect an opinion only, and no warranty is expressed or implied. Zuzim Inc. is likewise not bound by any prior or subsequent opinion, determination or certification of any independent grading service.

The Buy or Bid sale is not an approval sale and all sales are final. All claims of gross misdescription or any other claim, except claims regarding authenticity, must be made within 7 days of receipt of the item(s). Late payment constitutes just cause for revocation of return privileges. We must be notified before any item is returned. Returned items should be insured and shipping cost will be the responsibility of the buyer.

After 7 days item(s) may not be returned for any reason, except lack of authenticity. A claim of lack of authenticity must be made in writing by the original purchaser immediately after discovery that the item is not authentic. A signed letter from a recognized expert in the field must be included. Upon our acknowledgment of the claim the original purchaser must immediately return the lot in the same condition as at the time of the auction. Altered coins or items will not be accepted. Coins that have been encapsulated ("slabbed") by a grading and/or authentication service may not be returned for any reason, including authenticity. Zuzim Inc. reserves the right to have the coin examined by our own experts, and to make its own determination. If payment is made by credit card, rights of return are governed by these Auction Terms which supersede any rights of return specified by the card issuer.

12. Rights granted to purchasers and bidders under these Terms and Conditions of Sale are personal and cannot be transferred to any other person or entity whether by operation of law or otherwise.  Any attempt to assign or transfer any such rights shall be absolutely void and unenforceable.  No third party may rely on any benefit or right conferred by these terms and conditions of sale. The “purchaser” means the original purchaser of the property from Zuzim Inc. and not any subsequent owner or other person who may acquire or have acquired an interest therein.  If purchaser is an agent, the agency must be disclosed in writing to Zuzim Inc. prior to the time of sale, otherwise any rights shall be limited to the agent and not transferable to the undisclosed principal.

13. Bidders and purchasers, their heirs, agents or affiliates hereby waive any claim for incidental, consequential or exemplary damages arising from this sale, of whatever kind or nature, whether known or unknown, which they may claim to have with respect to and/or arising out of title to any goods purchased, or the sale itself, except for reimbursement in the amount equal to any bid actually paid by purchaser, where such reimbursement is authorized in these Terms and Conditions of Sale. The sole remedy that any participant in the auction shall have for any claim or controversy arising out of the auction shall be a refund, without interest, of all or part of the purchase price paid by the participant. 

14. Any dispute regarding this auction shall be governed by the laws of New York and shall be adjudicated only by the courts of New York; all bidders submit themselves to the personal jurisdiction of these courts for this purpose. All bidders consent to the confidentiality of consignors’ identities and waive any right to require disclosure of the name of the consignor or owner of any auction lot, whether such right is based on New York GOB §5-701(a) or any other provision in any jurisdiction.
